Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of hosting services provided by Northbrik Systems Ltd ("Northbrik", "we", "us"), company number 17184680, registered in England and Wales.
By ordering, paying for, or using any Northbrik service, you agree to these Terms, our Privacy Policy, and our Service Level Agreement where applicable.
If you do not agree, you must not use our services.
2. Services covered
These Terms apply to all Northbrik hosting products, including VPS hosting, web hosting, and game hosting (including Minecraft Java and Bedrock servers).
Services are provided from in-house UK infrastructure operated by Northbrik. Specific plan limits (CPU, RAM, storage, bandwidth, player slots, and sites) are defined at the point of order.
3. Your responsibilities
You are responsible for all activity on your account and everything hosted on your VPS, website, or game server.
You must keep login credentials secure, maintain lawful configurations, apply security updates to software you install, and ensure you have all rights and licences for content you host.
You must provide accurate registration and billing information and notify us promptly of any unauthorised use of your service.
4. Acceptable use
You may use Northbrik services only for lawful purposes. We operate a strict acceptable use policy. The following are prohibited without exception:
- Hosting, linking to, distributing, or facilitating illegal content or illegal activity under the laws of England and Wales, the United Kingdom, or the jurisdiction where your content is accessed
- Websites or services that promote or enable fraud, scams, phishing, identity theft, financial crime, or deceptive practices
- Malware, viruses, ransomware, botnets, command-and-control infrastructure, cryptojacking software, or any code intended to damage or gain unauthorised access to systems
- Denial-of-service attacks, port scanning, brute-force attacks, exploitation attempts, or any activity that disrupts Northbrik infrastructure or third-party networks
- Unsolicited bulk email (spam), SMS spam, or messaging abuse sent from or through our network
- Copyright or trademark infringement, including pirated software, media, or unlicensed game content where you do not hold rights
- Child sexual abuse material (CSAM) or any content that sexualises minors. We report such material to the relevant authorities immediately
- Terrorism, violent extremism, or content that incites violence or hatred where prohibited by law
- Human trafficking, illegal drugs, illegal weapons, or other goods and services prohibited by UK law
- Operating open proxies, open mail relays, or Tor exit nodes without our prior written approval
- Cryptocurrency mining, blockchain nodes, or similar high-load workloads unless explicitly permitted on your plan
- Resource abuse, including attempts to bypass plan limits, unfair consumption of shared node capacity, or activity that degrades service for other customers
This list is not exhaustive. We may treat any use that poses legal, security, reputational, or operational risk to Northbrik or others as a breach of these Terms.
5. VPS hosting rules
VPS customers have root or administrative access. That access does not reduce your obligation to comply with these Terms.
The following are strictly prohibited on VPS services unless we have given prior written approval:
- Hosting illegal websites, marketplaces, or forums
- Bulletproof hosting, anonymiser services primarily used to evade law enforcement, or services marketed for illegal use
- Bulk scraping or crawling that violates third-party terms of service or applicable law
- Storage or distribution of stolen credentials, leaked databases, or doxxing material
- Running public file-sharing or "warez" services
- Any workload that causes sustained network abuse or repeated abuse complaints attributable to your IP address
We may inspect resource usage, network traffic patterns, and abuse reports to protect the platform. We do not routinely monitor private server content, but we act on credible reports and legal obligations.
6. Game hosting rules
Game hosting (including Minecraft) must comply with these Terms and the rules of any game software you run.
The following are prohibited on game servers:
- Using the server to distribute cheats, hacks, cracked clients, or pirated game files
- Harassment campaigns, swatting, doxxing, or using in-game systems to facilitate illegal activity
- Misrepresenting the server to users for fraud or scam purposes
- Circumventing player limits, anti-cheat systems, or platform rules through technical abuse
- Hosting content or builds that violate Mojang or other rights-holder policies where that use is unlawful or brings credible legal complaint
We may suspend game servers that generate abuse complaints, DDoS reflection, or outbound attack traffic, even if the game software itself is permitted.
7. Web hosting rules
Web hosting customers must ensure every site on the account complies with section 4.
You must not host phishing pages, scam landing pages, malware droppers, or cloaked redirect chains.
You must respond promptly if we notify you of compromised sites, outdated CMS installs, or open upload vulnerabilities on your account.
8. Enforcement
We take violations seriously. We may, at our sole discretion and without prior notice where necessary:
- Issue a warning and require remediation within a stated deadline
- Restrict network access, ports, or outbound email
- Suspend some or all services immediately
- Terminate services without refund
- Preserve and disclose information to law enforcement, regulators, or rights holders where required or appropriate
- Recover costs arising from abuse, including mitigation, investigation, and third-party complaints
For severe violations, including illegal content, malware, attacks, or CSAM, we suspend first and investigate. We are under no obligation to provide a grace period where immediate action is required to protect people, property, or the platform.
9. Reporting abuse
To report abuse on our network, use our abuse report form at https://northbrik.com/report-abuse or email hello@northbrik.co.uk with the IP address, hostname, URL, timestamps (UTC), and a clear description of the issue.
For urgent security incidents or illegal content, include "URGENT ABUSE" in the subject line.
We review credible abuse reports and aim to acknowledge them within 24 hours. Critical reports are prioritised.
10. Backups and data
You are responsible for maintaining your own backups unless a backup feature is explicitly included in your plan.
Suspension or termination under these Terms may result in deletion of data after a reasonable retention period.
We are not liable for data loss caused by your actions, software failures, or enforcement under these Terms.
11. Payment and refunds
Fees are due in advance unless otherwise agreed in writing. Failure to pay may result in suspension or termination.
Services suspended or terminated for breach of these Terms are not eligible for refund, including for unused time.
Chargebacks filed in bad faith after a violation may result in permanent account closure and recovery action.
12. Limitation of liability
To the fullest extent permitted by law, Northbrik is not liable for indirect, consequential, or special losses, including loss of profit, revenue, data, or goodwill.
Our total liability for any claim relating to a service is limited to the fees paid by you for that service in the three months before the event giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
13. Indemnity
You agree to indemnify and hold harmless Northbrik, its directors, and employees against claims, fines, losses, and reasonable costs arising from your use of the services, your content, your breach of these Terms, or infringement of third-party rights.
14. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date.
Continued use of services after changes take effect constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer protection law in your country of residence gives you additional rights.
